Students with Attention Deficit Hyperactivity Disorder (AD/HD)

Depending on the severity and functional limitations caused by the Attention Deficit Hyperactivity Disorder, ADHD, the student may be eligible for services through the Office for Disability Services, ODS. In order for ADHD to be considered a disability, the student must demonstrate through documentation that their condition meets the definition of a disability under Section 504 of the Rehabilitation Act, 1973 and the Americans with Disabilities Act (ADA) 1990. According to these laws, the definition of a disability is a physical or mental impairment that substantially limits one or more major life activities. ODS requires specific information from both the student and the student's provider to determine if the student's condition is considered a disability under these laws and if the student is eligible to receive academic adjustments, auxiliary aids and/or services.

The essential feature of Attention-Deficit/Hyperactivity Disorder is a persistent pattern of inattention and/or hyperactivity-impulsivity that is more frequently displayed and more severe than is typically observed in individuals at a comparable level of development.   Some inattentive and/or hyperactive-impulsive symptoms that cause impairment must have been present before seven years of age, although many individuals are diagnosed after the symptoms have been present for a number of years, especially in the case of individuals with the Predominantly Inattentive Type.   Some impairment from the symptoms must be present in at least two settings (e.g., home, school, work).   There must be clear evidence of interference with developmentally appropriate social, academic, or occupational functioning.  The disturbance does not occur exclusively during the course of a Pervasive Developmental Disorder, Schizophrenia, or other Psychotic Disorder and is not better accounted for by another mental disorder (e.g., a Mood Disorder, Anxiety Disorder, Dissociative Disorder, or Personality Disorder)” (DSM-IV, p. 78).
